The following stipulations establish the general conditions of sale applicable to reservation services provided by XXXX.

Our services

Bemyspa.com is a spa booking service operated by XXX  through which you as a user (can book a spa treatment,  a stay in a spa resort, airport transfers, sight seeing tour, or purchase spa vouchers.  

Bemyspa.com only acts as the intermediary between our website users and the participating hotels, day spas, resort spas and clinics so we do not have and never intend to have any contractual involvement in your reservation. When you use Our Services to make a reservation, the contract is made directly between you and the hotel concerned.

Meanwhile, you agree that you will only use Our services to make legitimate inquiries, reservations or purchases, and will not use Our services for any purpose that is unlawful or prohibited by these Terms, including without limitation, to make any speculative, false or fraudulent reservation or any reservation in anticipation of demand. You further agree that you will not use any device, software or routine to interfere or attempt to interfere with the proper working of the Service and will not send automated queries of any sort to the Service.

 The contents of our website and all reservation made using Our Services shall be governed by and construed in accordance with the laws of the Singapore.

Booking

The prices displayed on Bemyspa.com vary according to seasons and periods as negotiated between us and the participating spas, resorts and clinics. The latter negotiated prices can differ from the prices published elsewhere (such as other online booking systems) that have negotiated their own prices.

In a similar way, the information contained in Bemyspa.com is provided and updated by the hotels from time to time, therefore the information displayed on our website may prove to be inaccurate despite our efforts to constantly update the website.  While the website is translated into several languages, the English version prevails.

A booking only starts upon verification of the validity of the credit card information. After confirmation, Bemyspa will proceed to the verification of the avaibility of the rooms/spa treatment/transfer/tours booked through our website within 5 business hours. Upon confirmation of the booking from our side, the booking is automatically processed as noticed in a mail send on the e mail address provided. Please make sure of the validity of your e mail address since this mila will serve as proof of valid reservation and will contain relevant information of the reservation and particulars of the hotel concerned. This mail should be produced during the check in at an hotel/resort spa/day spa/clinic.

In case of non confirmation of room/treatment avaibility, Bemyspa will provide alternative proposition according to the flexibility criteria filled in during the booking process. The user is free to accept to check the avaibility of some of these options if found suitable or cancel the booking process. If the former option is selected, bemySpa will retain the credit card information from the user and upon confirmation of the alternative proposition selected by the user by the partner hotel/resort spa/day spa/clinic, Bemyspa will proceed with the booking and debit the credit card.

 Payment and credit card information

For any hotel/resort spa/day spa/clinic on-line reservation the user will have to provide Bemyspa with his credit card information such as its number and expiry date. When the user’s reservation is confirmed, a full payment of the booking will be charged to his credit card in US Dollars, Australian Dollars, Yen, Euro or GB Pound according to the currency selected by the user. Our system accepts cards such as VISA, MasterCard. Please not we are using SSL encoding protocols to best ensure the protection of your credit card information. However, if credit information is lost during the transmission of the information, this loss should be borne only by the user.

Currency conversion

Currency rates are based on various publicly available sources and should be used as guidelines only. Rates are not verified as accurate, and actual rates may vary. Check the date on the currency converter feature for the day that currency was last updated. The information supplied by this application is believed to be accurate, but Bemyspa do not warrant or guarantee such accuracy.

Hotel booking cancellation

As indicated on our website during the booking process, each hotel has its own terms and conditions for cancellation of validly-confirmed reservation. In case of cancellation, we strongly advice the user to quickly get in touch with the hotel directly to minimize any penalty or charges payable. The user is free to notice a cancellation to Bemyspa but we do not guarantee an optimal responsiveness (as we prioritize booking confirmation).

Please note that all issues relating to cancellation of reservation shall be settled directly between the user and the partner hotel/resort spa/day spa/clinic. When penalties do apply, based on the terms and conditions of the hotel prevailing at the time when you made the reservation, we will pass on your credit card information to the hotel concerned so that the hotel may directly charge to your credit card account all penalties or charges which you are liable to pay for the cancellation: a user making a reservation through Bemyspa.com has unconditionally and irrevocably authorized and consented to our release of his credit card information to the hotel/resort spa/day spa/clinic concerned for this purpose.

Disclaimer

Bemyspa merely acts as an intermediary between the user and the hotel/resort spa/day spa/clinic. Therefore, Bemyspa cannot have control over the quality of the spa treatments delivered, the accommodation or the charges of the partner. Bemyspa has therefore no liability regarding the delivery of the services provided by our partners and any complaint should be directly addressed between the customer and the partner. Otherwise, the customer has the responsibility of having a valid VISA to go to his destination (information concerning the later is displayed in our travel guides that can be downloaded on the profile page of each of our partner).

In order to improve our services, we could ask you to fill in a questionnaire after checking out of the hotel/resort spa/day spa/clinic.

Without prejudice to the generality of the matters aforesaid, in the event that either we or the hotels are held liable by any court of competent jurisdiction to pay any damages or compensation to you, you agree and accept that the amount of such damages or compensation shall in no circumstances exceed the total amount of money actually paid by you to the hotel concerned for the reservation or the sum of 1,000 Euros, whichever is the least
